1. Can all criminal offenses be expunged or sealed?
No. Criminal offenses that involve children, that are aggravated, sexual in nature or involve DUI or DWI are not likely to be expunged.
2. Are there any circumstances that may change the answer for the above referenced criminal offenses?
The only circumstance that may make a difference is if any of these only resulted in an arrest and charges were dropped, but the charge is still showing on a person's criminal history record.
If you have a minor criminal charge on your criminal history that has been dismissed or the charges were dropped then you may qualify for that charge to be removed through the expungement process. If you committed a minor criminal offense as a juvenile and that offense was dismissed, charges dropped or you completed the punishment issued by the Court, you may qualify to have that offense permanently sealed.
